Terms of Service

These Terms of Service ("Terms") govern your use of ScoutStream Pro at scoutstreampro.com and the ScoutStream Pro mobile app (collectively, the "Service"), operated by TradeStream Marketing Corp ("ScoutStream", "we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

We are a Florida corporation with our principal mailing address at 9610 NW 24th St, Sunrise, FL 33322.

1. The Service

ScoutStream Pro is a field-canvassing platform for service-trade contractors. The Service lets you tag properties, look up owner or occupant contact information via skip-trace, send physical postcards, place calls and send SMS through ScoutStream-issued virtual phone numbers, and check the federal and state Do Not Call (DNC) registries.

2. Account eligibility and accuracy

You must be at least 18 years old and using the Service in connection with a legitimate trade or service business. You agree to provide accurate registration information, keep your password confidential, and notify us of any unauthorized account access.

3. Subscription and fees

ScoutStream is a subscription service. Some features are billed on a per-use basis (for example, per postcard sent, per skip-trace performed, per DNC check). Current pricing is shown on the pricing page and at the point of each chargeable action. All fees are non-refundable except as required by law. We may change fees on prospective notice.

Charges for print-and-mail orders are governed by Section 16 (Print and Mail Fulfillment Services), which describes the separate platform service fee and pass-through fulfillment cost components.

4. Your data and content

You retain ownership of the data you upload, the property notes you create, and the photos you capture. You grant ScoutStream a license to host, process, transmit, display, and back up your content for the purpose of operating the Service for you.

5. Skip-trace data — your representations and responsibilities

When you use the skip-trace feature, you represent that:

  • You have a permissible purpose under applicable law (including the Fair Credit Reporting Act, where applicable) for obtaining the information;
  • You will use the information only for marketing or business outreach in connection with your trade or service business — not to harass, locate fugitives, stalk, discriminate, or for any purpose prohibited by law;
  • You will not resell or redistribute skip-trace results.

The skip-trace results are sourced from third-party data aggregators and may be inaccurate or out of date. We do not warrant accuracy or completeness.

6. Outbound communications — TCPA, CAN-SPAM, DNC compliance

You are solely responsible for ensuring that postcards, calls, and SMS you send through the Service comply with:

  • The Telephone Consumer Protection Act (TCPA) and FCC rules;
  • State telephone-solicitation laws (including the Florida Telephone Solicitation Act);
  • The CAN-SPAM Act and equivalent state laws;
  • The federal and state Do Not Call (DNC) registries.

ScoutStream offers DNC-check tooling as a convenience. Using or ignoring that tooling does not transfer responsibility for compliance to us. You agree to maintain records of consent and to honor opt-out requests promptly.

7. Virtual phone numbers

ScoutStream-issued virtual numbers are leased to you for the duration of your subscription. We may reclaim numbers if your account is terminated for cause, if the underlying carrier reclaims the number, or if non-payment occurs. Calls and SMS routed through the Service may be logged, and recordings or transcripts may be stored if you enable them; you are responsible for compliance with two-party consent and notice requirements in your jurisdiction.

8. Mobile app permissions

The mobile app may request permission to access location, camera, and other device features. We use these only as needed to provide the features you invoke. You may revoke any permission in your device settings, but doing so may disable certain features.

9. Acceptable use

You agree not to:

  • Use the Service to send spam, harass, or threaten any person;
  • Use the Service in violation of any law, including those listed in Section 6;
  • Upload content you do not have the right to upload;
  • Reverse-engineer, scrape, or copy substantial portions of the Service;
  • Interfere with the operation or security of the Service.

10. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, that skip-trace results are accurate, or that postcards will be delivered within a specific time frame.

11. Limitation of Liability

To the maximum extent permitted by law, neither TradeStream Marketing Corp nor any of our officers, directors, employees, or affiliates will be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost goodwill, arising out of or relating to your use of the Service. Our total aggregate liability arising out of or relating to these Terms or the Service is limited to the amounts you paid us in the twelve (12) months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless TradeStream Marketing Corp and its officers, directors, employees, and affiliates from any claim, demand, damage, or expense (including reasonable attorneys' fees) arising from your use of the Service (including outbound calls, SMS, or postcards you sent) in violation of these Terms or applicable law.

13. Suspension and termination

We may suspend or terminate your account for violation of these Terms, for non-payment, for suspected fraud, or for materially improper use of skip-trace data or outbound channels. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

14. Changes to these Terms

We may update these Terms. Material changes will be communicated by email or in-product notice. Your continued use after notice constitutes acceptance.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts.

16. Print and Mail Fulfillment Services

(a) Third-Party Fulfillment. ScoutStream is a software-as-a-service platform. ScoutStream does not print, manufacture, package, address, or mail any physical materials. All print production, addressing, postage, and mailing services made available through the ScoutStream platform (“Fulfillment Services”) are performed by independent third-party vendors selected by ScoutStream (collectively, “Fulfillment Vendors”). The identity, location, and contact information of specific Fulfillment Vendors are proprietary and confidential to ScoutStream and will not be disclosed to User. ScoutStream reserves the right to add, replace, or substitute Fulfillment Vendors at any time, in its sole discretion, without notice to User. ScoutStream’s role is limited to providing software, targeting, automation, order routing, branding, customer support, and payment-processing functionality.

(b) User as Economic Purchaser. When User initiates a print-and-mail order through the ScoutStream platform, User is the economic purchaser of the Fulfillment Services from the applicable Fulfillment Vendor. ScoutStream facilitates the transaction on User’s behalf as an agent and technology intermediary and does not take title to, hold inventory of, or assume ownership of any tangible printed materials at any point in the transaction.

(c) Charges and Pricing Structure. Amounts charged in connection with print-and-mail orders may include: (i) a ScoutStream platform service fee representing consideration for software, targeting, automation, address validation, order management, branding, and related digital services provided by ScoutStream; and (ii) a pass-through fulfillment cost equal to the amount charged by the applicable Fulfillment Vendor to ScoutStream for User’s order, including without limitation printing, materials, handling, postage, and any sales, use, or excise taxes assessed by the Fulfillment Vendor. The ScoutStream platform service fee is consideration for software and digital services only and is separate from the cost of any tangible printed materials.

(d) Sales Tax on Printed Materials. Any applicable sales, use, or excise tax on tangible printed materials and related fulfillment services is assessed and collected by the Fulfillment Vendor at the point of production, based on the delivery destination and the Fulfillment Vendor’s own tax-registration obligations. ScoutStream does not separately assess or collect sales tax on tangible printed materials and makes no representation that the tax collected by the Fulfillment Vendor satisfies any tax obligation the User may have in the User’s own jurisdiction. User is solely responsible for any additional tax obligations arising from User’s use of the printed materials in User’s business.

(e) Authorization to Facilitate. User hereby authorizes ScoutStream to: (i) transmit User-submitted content, recipient addresses, and order details to Fulfillment Vendors for the purpose of producing and mailing User’s orders; (ii) procure Fulfillment Services from Fulfillment Vendors on User’s behalf; and (iii) charge User’s payment method on file for the combined platform service fee and pass-through fulfillment cost in a single transaction.

(f) Return Address; Branding. The return address printed on User’s mailings will reflect User’s business name and address as configured in User’s ScoutStream account. ScoutStream’s name, address, and the name and address of any Fulfillment Vendor will not appear on User’s mailings. All order confirmations, tracking notifications, and support communications related to User’s mailings will be issued under ScoutStream branding.

(g) Fulfillment Vendor Performance. ScoutStream makes no warranty, express or implied, regarding the timeliness, print quality, delivery, or accuracy of services performed by Fulfillment Vendors or the United States Postal Service. Production timelines, print quality, mail handling, and delivery are controlled exclusively by the Fulfillment Vendor and applicable postal carriers. User’s sole and exclusive remedy for any Fulfillment Vendor error, defect, or non-delivery shall be a reprint or refund limited to the amount paid by User for the specific order at issue, at ScoutStream’s reasonable discretion. User shall direct all inquiries, complaints, and remediation requests to ScoutStream support, not to any Fulfillment Vendor directly. User agrees not to attempt to contact, engage, or contract directly with any Fulfillment Vendor identified or suspected to be performing Fulfillment Services for the ScoutStream platform.

(h) Non-Circumvention. User agrees that during the term of User’s use of the ScoutStream platform and for a period of twelve (12) months thereafter, User will not knowingly solicit, contract with, or procure print-and-mail services directly from any Fulfillment Vendor that User identifies as a Fulfillment Vendor for the ScoutStream platform, for the purpose of replicating or substituting the Fulfillment Services available through ScoutStream. Nothing in this Section restricts User from independently engaging any print or mail vendor for unrelated business purposes.

(i) Content Responsibility and Legal Compliance. User is solely responsible for the content of any flyer, mailer, postcard, or other marketing material submitted through the ScoutStream platform. User represents and warrants that all such content complies with applicable advertising, consumer-protection, fair-housing, telemarketing, contractor-licensing, do-not-mail, and similar laws and regulations. User shall indemnify and hold harmless ScoutStream and its Fulfillment Vendors from any claim arising out of the content of User’s mailings or User’s selection of recipients.

(j) No Tax, Legal, or Compliance Advice. Nothing in this Section constitutes tax, legal, or regulatory advice. User is encouraged to consult its own advisors regarding the tax and legal treatment of its use of the ScoutStream platform and the Fulfillment Services.
